Employment Insurance Act
The Employment Insurance Act aims to stabilize the lives and employment of workers and to promote employment by providing unemployment benefits (insurance benefit) and employment insurance services when workers become unemployed or receive vocational training.Purpose
Article 1: The purpose of the Employment Insurance is to stabilize the standard of living and employment of workers by providing necessary benefits for workers who are unemployed, who are having trouble continuing employment or who are receiving job-related training, and to facilitate their job-seeking activities, as well as to prevent unemployment, redress the employment situation, increase employment opportunities, develop and improve the capacity of workers, and promote their welfare, so as to contribute to their employment security.
Conditions for joining employment insurance
All workers who meet the following three conditions are eligible for or must be covered by employment insurance.
- 1. Expected to work for 31 days from the start of work.
- 2. Working more than 20 hours per week
- 3. Not being a student
Each condition is explained in detail in the following sentences.
Be expected to work 31 days
- Have worked more than 31 days
- a fixed-term contract provides that "may be renewed an employment contract"
It means that any of the above is applicable, and that it is not expected to be terminated employment contract within 31 days.
Working more than 20 hours per week
Working more than 20 hours per week must be continuous, and this requirement is met if the contract requires working more than 20 hours per week. If you work more than 20 hours temporarily, you will not be able to meet this requirement.
Not being a student
The exception to this is as follows. Even if you are a student, if you are expected to graduate from school and you are supposed to work for the company after graduation, you can obtain employment insurance under the conditions listed in 1 and 2. Correspondence education and night school students are also allowed as exceptions.
Benefits of employment insurance
If you have employment insurance, you can receive the following benefits when you are unemployed.Unemployment benefit
It is a basic benefit, and you can receive a benefit that supports your life even when you lose your job. Even in the case of dismissal, if you apply to Hello Work (employment security office), you can receive benefits in the same way.
The amount of benefits received per day is called "daily basic allowance". 50~80% of the total wages for the six months before resignation is divided by 180 days. The maximum number of days you can receive is determined by your age, and the maximum number for 45~60 years old is the highest.
Educational training benefits
Education and training benefits are paid as a subsidy for the cost of acquiring a qualification or taking a course for the purpose of improving skills on one's own will. There are two types of educational training benefits: "Education benefits for general education and training" and "Educational training benefits related to participation in specialized practical training". The latter is particularly distinguished.
In the former, 20% of the education and training expenses are paid with the upper limit of 100,000 yen and the lower limit of 4000 yen. In the latter case, 50% of the cost of education and training is paid up to 400,000 yen per year when a person takes a training course specified by the Minister of Health, Labour and Welfare. An additional 20% will be provided to those who obtain a specific qualification after training and are subsequently employed.
Other benefits
In addition to the above benefits, there are various other benefits available depending on the situation, such as continuous employment benefits for the elderly that can be received when wages fall to less than 75% of the previous level when they become 60 years or older, childcare leave benefits and family care leave benefitsthat can be received when they are forced to leave due to child care or family care.
The Employment Insurance Act is a law designed to stabilize the lives and employment of workers and, by extension, to promote employment.
