States Parties recognize the right of a child who has been placed by the competent authorities for the purposes of care, protection or treatment of his or her physical or mental health, to a periodic review of the treatment provided to the child and all other circumstances relevant to his or her placement.

This Article was enacted to ensure that the health and treatment of children separated from their families for various reasons are regularly reviewed to guarantee that the children receive appropriate care, protection, and treatment.

This is due to problems such as abuse occurring in children's homes and hospitals. In particular, children's homes have been protecting large groups of children in a single facility, leading to stress for the children because of the large number of children and making it difficult for the staff to notice abuses. In Japan, it is recommended that children in need of social care be protected in small groups as much as possible, and measures are being taken to provide an environment similar to that of a home as far as possible.

Moreover, respecting children's opinions in terms of guaranteeing their rights is highly important. In order to confront the mental state of children who have frequently been raised in violation of their human rights, a high level of expertise of facility staff is required, and not only care during foster care but also aftercare to support the child's relationship with the community after leaving the facility is also considered important.
