- The inducement or coercion of a child to engage in any unlawful sexual activity;
- The exploitative use of children in prostitution or other unlawful sexual practices;
- The exploitative use of children in pornographic performances and materials.
This article is intended to protect children from sexual abuse, and the exploitation of prostitution and other forms of exploitation listed in item b is similar to that listed in Article 11 of this Convention, which protects children from being illegally transferred out of the country. The only other item listed in Article 34 is “unlawful sexual practices,” referring to sexual exploitation inside the country, as well as to transfer outside of the country.
Japan has laws against the above sex crimes as follows.
Article 176 of the Penal Code - Indecency through Compulsion
A person who forcibly commits an indecent act through assault or intimidation upon another person of not less than thirteen years of age is punished by imprisonment for not less than 6 months but not more than 10 years. Article 177 of the Penal Code - Forcible Sexual Intercourse
A person who, through assault or intimidation forcibly engages in vaginal intercourse, anal intercourse or oral intercourse (hereinafter referred to as "sexual intercourse") with another person of not less than thirteen years of age is guilty of the crime of forcible sexual intercourse, and is punished by imprisonment for a definite term of not less than 5 years. Article 178 of the Penal Code - Constructive Indecency through Compulsion; Constructive Forcible Sexual Intercourse
A person who engages in an indecent act upon another person by taking advantage of their unconscious state or inability to resist, or by causing the person to lose consciousness or have the inability to resist, is punished in the same manner as prescribed for in Article 176.
